In certain situations, the court may order the appointment of an expert to advise him on the best interests of the child. In this situation, it is at the discretion of the court to apportion the fees between the parties in its sole discretion, generally based on the financial situation and solvency of each party. If the parties take it upon themselves to appoint an expert, the general rule is that each party bears its own expert fees. However, upon request, it is at the discretion of the court to require a party to contribute to the other parties` legal costs, including expert fees. The division of property is one of the main issues in many divorce cases in Orange County. When it comes to multiple or complex financial assets, it may be important to use expert testimony to determine the correct valuation of those assets.

However, the combination of new requirements could constitute a consolidation that violates the CICA. See notes 9 to 10 and accompanying text. Procurement activities have sometimes claimed that the construction requirements themselves are new requirements or that adding a new requirement to previously executed requirements means that there is no consolidation. The key question in criminal proceedings is always whether the accused is guilty or innocent of the charges against him. Any result that does not answer the central question of guilt means that the verdict is not substantial. It is not difficult to find a story about a criminal who escapes justice due to intelligent legal techniques. Of course, what some call technical details could actually be fundamental rights set out in the Constitution. But the end result is the same: the guilt or innocence of the person in a criminal case or his responsibility in a civil lawsuit has not been established in a judicial proceeding.

On television and film, civil and criminal trials are portrayed as dramatic events; In real life, they move slowly, and they are often interrupted by side lectures and sometimes postponements. The late scholar Hand, a respected federal appeals judge, once said that after a death, serious illness or injury, what he would avoid most in his life is the party to a trial. When it`s all over, decisions are final and made with prejudice, but the peace that follows the divorce war of a trial can be as bad as war. In general, in divorce proceedings, as in all civil proceedings, routine begins with opening statements, and then the applicant presents evidence and testimony. Clear evidence must be provided that the subpoena and the complaint were served on the defendants, as well as the announcement of the hearing for the main hearing […].

Proper maintenance by defence counsel is crucial if the alleged coercion of the court of first instance is to be subject to review. The lawyer should object in due course if the specter of coercion envelops a jury in deadlock, if the error in the appeal is to be exorcised. Q: Stranded jurors pose a formidable dilemma for trial judges and lawyers who hope to avoid costly new trials and not get bogged down in a quagmire of lengthy deliberations. The main danger that the jury blockade poses to the negligent trial judge is the possibility of a reversal of the appeal due to the perception of judicial coercion. The hidden danger of conservation failure threatens the same premonition for inattentive litigants. Since Allen, almost every state has implemented a version of a stalemate. These Allen indictments promote the economy of justice by reducing the likelihood that an initially suspended jury will need a trial.11 The Allen indictment, contained in Florida Standard Jury Instruction 3.06, provides the following: As the previous discussion makes clear, avoiding the appearance of coercion is the primary consideration for the trial judge when an impasse between jurors occurs during deliberations.
